The Office of Legal Affairs is the legal team for the Department of Public Health and Human Services (DPHHS), providing representation and legal advice on a wide range of critical issues. OLA supports the development and implementation of the Department's programs by providing quality legal services including the development of contracts, participation in beneficiary and provider hearings, litigation, legislative drafting, negotiations and settlements, document review, providing training, advice regarding compliance with state and federal laws and regulations, and policy development. Applicants should have a passion for public service, and experience working in a collaborative legal office that still requires independent work. Below are more detailed job duties: * Responds to requests for legal research and options of legal questions within the Department, and provides verbal and written legal opinions. * Coordinates with external legal counsel on pre-litigation issues such as notices of claims, applicable statutory timelines, and investigation. * Coordinates program gathering of documents related to formal discovery requests (Interrogatories, Requests for Production of Documents, Requests for Admissions) and subpoena responses. * Assists external legal counsel with review of pleadings and provides Department-related subject matter expertise. * Assists with trial preparation and may, on occasion, be required to appear at mediation conferences, hearings, or trial. * Maintains knowledge of Department policies, manuals, and procedures. Confers with Department personnel involved with specific tort case issues as to application of these documents. May occasionally be asked to participate in policy, manual, or procedure update or amendment process. * Directs the work of support staff as necessary to meet the legal needs of clients. * Provides training to department staff on relevant legal issues as necessary. Physical and Environmental Demands: The majority of work occurs in a typical office environment. Extensive keyboarding and computer use is required. * Knowledge of legal analysis principles, practices and theories. * Knowledge of legal research methods and techniques, including use of LEXIS and the internet. * Ability to analyze difficult legal problems and synthesize a course of action. * Ability to maintain a positive, cordial, and effective relationship with co-workers throughout the Department. * Ability to develop a level of confidence between themselves and legal clients. * Advanced skill in written and oral communication. * Ability to use a personal computer, various software programs, and standard office equipment necessary to perform the functions of the position. Minimum Qualifications: * Juris Doctorate (J.D.) from an accredited law school. * Admission to practice law in Montana, or admission within one year from the date of hire. * Three years of legal experience. /Preferred/: * Admitted to practice of law in Montana. * Knowledge of the Montana Rules of Civil Procedure and Federal Rules of Civil Procedure. * Knowledge of administrative review procedures, all aspects of the Montana Administrative Procedures Act (MAPA), and judicial review procedures.
